Two Men Charged in Fatal Shooting


Lexington County Sheriff’s Department detectives in cooperation with the Muscle Shoals (Ala.) Police Department, Fairfield (Calif.) Police Department and Atlanta (Ga.) Police Department charged a 22-year-old man from Muscle Shoals, Ala. and a 26-year-old man from Fairfield, Calif. with shooting and killing one man and shooting and seriously wounding a second man on April 26 outside a home on Bushberry Road near Pelion. The 22-year-old man had arranged a meeting with the man who was shot and wounded in order to buy a motor vehicle from that man.

Lexington County Sheriff James R. Metts said Muscle Shoals Police Department officers arrested Justin Antonio Butler, 22, of 701 Dearborn Avenue, Apartment H, Muscle Shoals, Ala., on Friday, May 9 at the townhouse complex where Butler lives. Sheriff’s Department detectives requested assistance from the Muscle Shoals Police Department in arresting Butler after detectives entered Butler on the National Crime Information Center computer database as a person who was wanted on arrest warrants on charges of murder, attempted murder, first-degree burglary and possessing a weapon during the commission of a violent crime.

Butler was being held on Monday, May 12 at the Colbert County Jail in Tuscumbia, Ala., while Butler awaits extradition to Lexington County, Metts said.

On Saturday, May 10, detectives placed a detainer with the Solano County Justice Center Detention Facility in Fairfield, Calif., on Terry Renee McClure, 26, of 1006 Johnson Street, Fairfield, Calif., who is wanted on arrest warrants on charges of murder, attempted murder, first-degree burglary and possessing a weapon during the commission of a violent crime, Metts said.

Detectives will seek to return McClure to Lexington County when they are notified that McClure is scheduled to be released from the Solano County Justice Center Detention Facility, where McClure was being held on Monday on unrelated charges, Metts said.

Arrest warrants allege that at about 4:20 p.m. on April 26 Butler and McClure, who were armed with a handgun, willfully and with malice aforethought shot and fatally wounded Tycus Metricus Toland, 29, of 3835 Savannah Highway, North, Metts said. Butler and McClure shot Toland in his upper torso without just cause or provocation.

Arrest warrants further allege that at about 4:20 p.m. on April 26 Butler and McClure, who were armed with a handgun, acted with malice aforethought when they shot Vonkeith Toland, 33, in his upper torso at Vonkeith Toland’s home at 688 Bushberry Road near Pelion in an effort to kill Vonkeith Toland, Metts said. Tycus Toland was the brother of Vonkeith Toland.

In addition, arrest warrants allege that Butler and McClure were armed with a handgun when Butler and McClure broke into Vonkeith Toland’s home on April 26, Metts said.

Vonkeith Toland was listed in critical but stable condition on Monday at a local hospital, where Vonkeith Toland is expected to recover from injuries that he suffered when he was shot in his upper torso, Metts said. Detectives are continuing to investigate the motive for the shooting incident and the circumstances of the shooting incident.

At about 4:30 p.m. on April 26, deputies responded to a call concerning a shooting incident at Vonkeith Toland’s home and found Tycus Toland’s body in the front yard, Metts said. Tycus Toland was deceased, with one fatal gunshot wound to his upper torso.

Detectives think that Vonkeith Toland previously met Butler sometime within the past year through a mutual acquaintance, Metts said. Vonkeith Toland and Butler communicated by telephone prior to the shooting incident in order to arrange a meeting in North for Butler to discuss buying a motor vehicle from Vonkeith Toland. Vonkeith Toland arranged for Butler and McClure to follow Vonkeith Toland and Tycus Toland in a separate motor vehicle from North to Vonkeith Toland’s home near Pelion.

Butler and McClure shot Tycus Toland in the front yard of Vonkeith Toland’s home and shot Vonkeith Toland in the home’s backyard shortly after they arrived at the home, Metts said.
